Due to the requirements of the FCC's The Campaign Registry (TCR), as implemented by T-Mobile and Dialpad, we are required to include the following statement on our website to maintain our outbound SMS capabilities:

"No mobile information will be shared with third parties/affiliates for marketing/promotional purposes."

We are including this statement while we seek further clarification on its accuracy and scope. We believe this statement may not fully reflect the complexities of data usage under the TCR, particularly concerning common website analytics tools like Google Analytics and Google Tags.

We have requested guidance from T-Mobile/Dialpad and sought our own legal counsel on these specific issues, but have not yet received clear instructions. In the meantime, we want to assure you that we are committed to protecting your privacy and complying with all applicable regulations.

This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use Our Websites or Our mobile apps, Our social media sites, purchase products or services from Us, enter into contracts with Us, engage Us online or offline to inquire about the provision of services or otherwise interact with Us (collectively, the “Services”)and tells You about Your privacy rights and how the law protects You.

For the purposes of this Privacy Policy:

  • Consumer refers to every individual who is in the USA for other than a temporary or transitory purpose, and every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.

  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

  • Device means any device that can access Our Websites such as a computer, a cellphone or a digital tablet.

  • Do Not Track(DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.

  • Personal Information is any information that relates to an identified or identifiable individual.  Personal Information means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

  • Sensitive Personal Information is information that identifies, relates to or could reasonably be linked with You or Your household. For example, it can include social security numbers, driver’s license, state ID card or passport number, account log-in, financial account number together with any security code that allows access to an account, geolocation, racial or ethnic origin, or union membership, genetic data, biometric information, health or sexual orientation.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It also refers to third-party companies or individuals employed by the Company to facilitate, provide and perform the Services on behalf of the Company and to assist the Company in analyzing how the Services are utilized.

  • Third-Party Social Media Service refers to any website or any social network website or any mobile app through which a user can log in or create an account to use the Websites.

  • Usage Data refers to data collected automatically, either generated by the use of the Websites or from the Websites infrastructure itself (for example, the duration of a page visit).

  • Websites refers to the Landmark website, accessible from http://landmark.green/ and any other website, including social media sites, that direct You to this Privacy Policy on the Landmark website. 

  • You means the individual accessing or using the Websites, or the company, or other legal entity on behalf of which such individual is accessing or using the Websites, as applicable.

Collecting and Using Your Personal Information

Personal Information

While using Our Websites or inquiring about or engaging us to perform Services, We may collect certain personally identifiable information that can be used to contact, market to or identify You. Personally identifiable information may include, but is not limited to:

SMS Terms and Conditions

By opting in to SMS messaging from Landmark, you consent to receive text messages (SMS) from us regarding our services, promotions, or important updates. These messages may be sent via automated systems.

  • If assistance is required, customers can reply HELP for more information.

  • If customers no longer wish to receive SMS from us, they can unsubscribe by replying STOP to no longer receive messages.

  • Message and data rates may apply.

  • Message frequency may vary.

  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent.  This information will not be shared with any third parties.

Usage Data

Usage Data is collected automatically when using the Websites. Usage Data may include information such as Your Device’s internet protocol address (e.g. IP address), browser type, browser version, the pages of Our Websites that You visit, the time and date of Your visit, the time spent on those pages, geo-location data, unique device identifiers and other diagnostic data.

When You access the Websites by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.  We may also collect information that Your browser sends whenever You visit Our Websites or when You access the Websites by or through a mobile device.

 

Information from Third-Party Social Media Services

If You decide to register through or otherwise grant Us access to a Third-Party Social Media Service, such as Google, Facebook, or LinkedIn, We may collect Personal Information that is already associated with Your Third-Party Social Media Service’s account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service’s account. If You choose to provide such information and Personal Information, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

 

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Websites and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Websites. The technologies We use may include:

WE DO NOT SELL YOUR PERSONALLY IDENTIFIABLE INFORMATION. Retention of Your Personal Information

The Company will retain Your Personal Information so long as is needed for the purposes set out in this Privacy Policy or a related and compatible purpose consistent with the average consumer’s expectation and to comply with applicable laws and regulations. We consider the following criteria when determining how long to retain Personal Information: why We collected the Personal Information; the nature of the Personal Information; the sensitivity of the Personal Information; Our legal obligation related to the Personal Information, and risks associated with retaining the Personal Information.  We will retain and use Your Personal Information to the extent necessary to comply with Our legal obligations (for example, if We are required to retain Your data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies.  The Company will also retain Usage Data for internal analysis purposes.

Your information, including Personal Information, is processed at the Company’s offices and in any other place(s) where the parties involved in the processing are located, including the cloud. Usage, Performance and Miscellaneous

We may use third-party Service Providers to provide better improvement of Our Websites. For example, we use an invisible captcha service named reCAPTCHA. reCAPTCHA is operated by Google.
